All services provided by LightBound Hosting are to be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of
any United States federal, state or local law is prohibited. This includes, but is not
limited to, copyrighted material, material we judge to be threatening or obscene, material
that jeopardizes national security, or material protected by trade secret or other laws.
The subscriber agrees to indemnify and hold harmless LightBound Hosting from any claims
resulting from the customer's use of LightBound Hosting's services which damages the
customer or any other party.
LightBound Hosting has the responsibility to protect each customer and to provide the
best service possible. The following guidelines were designed to ensure these
obligations are met.
- Unacceptable Content. Customers are prohibited from storing
or posting adult content or linking to adult content elsewhere. In addition, sites
that promote, or link to, illegal activity or content that may be damaging to
LightBound Hosting, its servers, or any other server on the Internet, is
prohibited.
Examples of unacceptable content include, but are not limited to:
- pirated software
- warez sites
- hacking sites or programs
- music file distributions in which the account holder does not own
the copyright
- game servers
LightBound Hosting shall be the sole arbiter of what constitutes a violation of
this provision. Content that does not meet these standards will be removed without
prior notice.
- IRC. IRC servers, eggdrop bots, BNC, IRC bots, or IRC clients
are prohibited from running on LightBound Hosting servers.
- Proxy Servers. Proxy servers, or any likeness thereof, are
prohibited.
- PHP Shell. PHP shells, or any likeness thereof, are
prohibited.
- Server Abuse. Any attempt to undermine or cause harm to a
server or customer of LightBound Hosting is strictly prohibited.
LightBound Hosting will strongly react to any use, or attempted use, of an
account without the account owner's authorization. Such attempts include, but
are not limited to, "Internet scamming", phishing, password robbery, and
security hole scanning.
Any unauthorized use of accounts by a LightBound Hosting customer, whether or not
the attacked account or computer belongs to LightBound Hosting will result in
action against the offender. Possible actions include warnings, account suspension
or revocation, and civil or criminal legal action, depending on the seriousness
of the offense.
- Unsolicited Email. Unsolicted commercial advertisements are not
allowed in email, and will likely result in account cancellation. Commercial
advertisements are unwelcome in most Usenet discussion groups and on most email
mailing lists. Inappropriate posting may result in account cancellation. See the
newsgroup or mail list's charter to determine whether advertising is allowed.
Sending a message, especially an advertisement, to more than five (5) or six (6)
recipients, is by definition spamming, unless the individuals have specifically
requested to be added to a mailing list on that topic. Email is a person-to-person
medium, not a broadcast medium. No refunds will be issued if a customer's account
is terminated for spam.
- IP Address Ownership. LightBound Hosting assigns a customer
an IP address for use with the hosting plan. The customer shall have no right
to use that IP address for any other purpose except as permitted by LightBound
Hosting. LightBound Hosting shall maintain control and ownership of all IP
addresses assigned to customer. LightBound Hosting reserves the right to
remove, or otherwise change, such IP addresses at the sole discretion of
LightBound Hosting at any time.
- Export Laws. Customers may not use LightBound Hosting
services to export encryption software to points outside the United States in
violation of applicable export control laws.
- Remedies. If LightBound Hosting learns of a violation of
this Acceptable Use Policy, LightBound Hosting may, at its sole discretion, take
any or all of the following actions, with or without notice, as it deems necessary
and appropriate to the severity and duration of the violation:
- warning the customer
- suspending the customer's access to the account
- terminating or cancelling customer's account
- removing the offending content
- taking any other action in accordance with this Acceptable Use Policy or
applicable law.
- Reservation of Rights. LightBound Hosting reserves the right
to cooperate with and provide any and all customer information and data to
appropriate legal authorities in investigations or reporting of claims of illegal
activity involving LightBound Hosting's services. LightBound Hosting reserves all
other rights to respond to violations of this Acceptable Use Policy to the extent of
applicable law and in accordance with any applicable contractual obligations.
LightBound Hosting may utilize technical means to monitor communications into, and
out of, its network facilities to prevent the introduction of viruses or other
hostile code, to prevent intrusions and otherwise to enforce this Acceptable Use
Policy. Customer agrees that LightBound Hosting is authorized to monitor its
communications through LightBound Hosting's network for such purposes.
